1.No Purchase Necessary.

Must be 18 years of age and a legal resident of the United States to enter. The contest is open to the members of the Internet community. Employees, directors, and/or officers (including immediate family members or members of the household) of Rokform, its subsidiaries, affiliated companies, distributors, advertising, fulfillment and promotion agencies and all other companies or entities associated with the contest are not eligible to participate. The contest is void where prohibited or restricted by law. Participation constitutes entrant’s full and unconditional agreement and acceptance of these Official Rules, which shall be final in all respects.

2.How to Enter.

To enter to win the “Where Do You Mount Your Rokform” contest, contestants must provide first name, last name, a valid e-mail address, confirm they are 18 years of age in order to be eligible, and upload a photo of their mounted Rokform case. Any incomplete entries will not be eligible. Multiple entries not allowed. Only open to residents of the United States.  Last day to enter is 3/3/2013 at 11:59 pm PST.

To enter to win the “Fan of the Month” contest, contestants must provide first name, last name, a valid e-mail address, confirm they are 18 years of age in order to be eligible.  Any incomplete entries will not be eligible. Multiple entries not allowed. Only open to residents of the United States.

3.Winning.

Rokform team members will select the winning entry at their discretion. Rokform will be responsible for all applicable shipping and handling fees as well as applicable local taxes. If these rules differ from any promotional or other materials published in connection with the Contest, these rules shall control.

4.Conditions of Participation.

Rokform reserves the right to substitute a prize for an item of equal or greater value in the event all or part of a prize becomes unavailable. Prizes are awarded without warranty of any kind from Rokform, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local law or regulation. All federal, state, provincial and local laws and regulations apply. Submission of entry into this contest deems that entrants agree to be bound by the terms of these Official Rules and by the decisions of Rokform, which are final and binding on all matters pertaining to this contest. Return of any prize/prize notification may result in disqualification and selection of an alternate winner. Any potential winner who cannot be contacted within 15 days of first attempted notification will forfeit his/her prize and an alternate winner may be selected. The intellectual and industrial property rights to the contest submission, if any, will remain with the participants, except that these terms do not supersede any other assignment or grant of rights according to any other separate agreements between participants and other parties. To the extent permitted by law, entrants agree to hold Rokform, its parent, subsidiaries, agents, directors, officers, employees, representatives and assigns harmless from any injury or damage caused or claimed to be caused by participation in the contest and/or use or acceptance of any prize won, except to the extent that any death or personal injury is caused by the negligence of Rokform. Rokfrom is not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize. A participant may be prohibited from participating in this contest if, in Rokform’s sole discretion, it reasonably believes that the participant has attempted to undermine the legitimate operation of this contest by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other participants, Rokform or associated agencies. In the event a winner/potential winner’s employer has a policy, which prohibits the awarding of a prize to an employee, the prize will be forfeited and an alternate winner will be selected.

5.Liability.

By participating in this contest, you accept all risk and consequences of entry and participation in this contest, and agree to release and hold Rokform, its officers, directors, affiliates, employees, contractors, subsidiaries, agents and partners harmless from any and all consequences, liability, losses, damages (including without limitation, consequential, punitive, incidental, special or increased damages and those related to personal injury, death or damage to property) and costs and expenses, of any kind, under any legal theory, arising from or related to this contest, including but limited to your entry and participation in this contest, the acceptance and/or use (or misuse) of any prize, printing errors, any claims based upon rights of publicity and invasion of privacy. Entrant shall indemnify Rokform, its officers, directors, affiliates, contractors, subsidiaries, agents, employees and partners from and against all claims or suits and any damages or costs (including reasonable attorneys’ fees) arising from or relating to entrant’s violation or inaccuracy of any warrantees or representations made relating to this contest. Rokform assumes no responsibility for errors, which may occur in the transmission of entrant’s entry. Rokform is not responsible for any fraud or misconduct on the part of the entrants. Should an entrant engage in fraud or misconduct of any nature, including but not limited to a violation of the Official Rules, such entrant shall be subject to immediate disqualification. Rokform reserves the right to terminate, modify or amend the contest at any time if the fairness, integrity, and or proper administration of the contest is jeopardized. IN NO EVENT SHALL SIMPLICIKEY BE LIABLE TO ENTRANT FOR ANY LOST PROFITS, OR FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL OR OTHER INDIRECT DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS CONTEST. Entrant’s sole damages shall be limited to entrant’s actual out of pocket expenses, excluding attorneys’ fees. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND CONTEST ENTITIES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSES AND/OR NON-INFRINGEMENT.

6.Warranty and Indemnity.

Each entrant certifies that their entry is original and that they are the sole and exclusive owner and right holder of the submitted entry, and that they have the right to submit the entry in the contest. Each entrant agrees not to submit any entry that (1) infringes any 3rd party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or (2) otherwise violates applicable law in any countries in the world. To the maximum extent permitted by law, each entrant indemnifies and agrees to keep indemnified Rokform, its parent, subsidiaries, agents, directors, officers, employees, representatives and assigns harmless at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the participant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each participant indemnifies and agrees to keep indemnified Rokform, its parent, subsidiaries, agents, directors, officers, employees, representatives and assigns harmless at all times from and against any liability, actions, claims, demands, losses, damages, costs and expenses for or in respect of which Rokform will or may become liable by reason of or related or incidental to any act, default or omission by a participant under these Official Rules including without limitation resulting from or in relation to any breach, non-observance, act or omission whether negligent or otherwise, pursuant to these official rules by a participant.

7.Data Privacy.

Participants agree that personal data, especially name and address, may be processed, stored and otherwise used for the purposes and within the context of the contest and any other purposes outlined in these Official Rules. The data may also be used by Rokform in order to check participants’ identity, their postal address and telephone number, or to otherwise verify their eligibility to participate in the contest and to receive any prize.

8.INTERNET

Rokform is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission. Rokform is not responsible for theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. Rokform is not responsible for inaccurate transmissions of or failure to receive entry information by Rokform on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof, except to the extent that any death or personal injury is caused by the negligence of the Rokform. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, disruption or termination of the wildfireapp.com website for any reason or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, Rokform reserves the right at its sole discretion to immediately cancel, terminate, modify or suspend the contest. Rokform reserves the right to select winners from eligible entries received as of the termination date. Rokform further reserves the right to disqualify any individual who tampers with the entry process. Caution: Any attempt by a contestant to deliberately damage any website or undermine the legitimate operation of the contest is a violation of criminal and civil laws and should such an attempt be made, Rokform reserves the right to seek damages from any such contestant to the fullest extent of the law.

9.Entire Agreement.

These terms set forth the entire agreement between the parties relating to the subject matter hereof, and supersede all prior agreements and understandings relating thereto, whether oral or written. ShortStack is neither a Rokform app nor an affiliate of this contest.

We reserve the right to exclude a participant from contention if we deem your username, profile information, or your “Comments” and/or “Tweets,” in general, are offensive or spam.

By playing, you give us permission to use your name and profile information to announce as a winner.

What you send us becomes our property.
By participating in this promotion, the winners agree to allow Rokform,Inc. to use their name, image, likeness and/or voice in any media whatsoever including press, print, radio and television, for the purpose of advertising, trade or promotion without any further compensation whatsoever being due or payable to such winners by Rokform, Inc., its parent company or any of its affiliated companies. If potential prize winners cannot be contacted, or if a potential winner does not claim his/her prize within seven (7) days of notification by Rokform, Inc., or if he/she is found to be ineligible or if he/she cannot or does not comply with these Rules, that potential winner will be disqualified, and the prize will be forfeited. An alternate potential winner may also be selected at Rokform, Inc.’s sole discretion. In order to claim and receive the cash prize, the potential winner will be required to sign Rokform, Inc.’s Liability Release. Failure or inability to sign that release will result in the potential winner being disqualified and an alternate winner selected at Rokform, Inc.’s sole discretion. Rokform, Inc. reserves the right to modify, suspend, cancel, or terminate this promotion within its sole discretion and reserves the right to disqualify any entrant in its sole discretion. By entering or participating in this promotion participants agree to be bound by these promotion rules. The decisions of Rokform, Inc. are final in all matters related to the promotion and no correspondence will be entered into thereon.

Some offers are void outside of the fifty (50) states of the United States and the District of Columbia and wherever prohibited by national, state, or any governmental laws. All federal, state, and local laws and regulations apply to these Sweepstakes/Contests/Promotions.  No prize transfers, cash redemption or substitutions permitted except in the event of unavailability of prize(s), in which case Sponsor may, in its own discretion, substitute a prize of equal or greater value.  All federal, state and local taxes on prizes, if any, are the sole responsibility of the giveaway recipient/s.  The Sweepstakes is also subject to these Official Rules. There will be one (1) winner and one (1) prize given unless otherwise stated by Sponsor. No substitution, transfer, or cash equivalent of the Prize is allowed by any winner. Sponsor, at its sole discretion, may substitute a prize of equal or greater value. All federal, state and local taxes on prizes, and any registration and licensing fees and charges are the responsibility of the winner. DRAWING AND NOTIFICATION The Sweepstakes winner will be selected in a random drawing on or about the last day of each month or when the promotion dates are stated; from all eligible entries received by the judge(s), whose decisions are final and binding in all respects. Odds of winning depend on the number of eligible entries received. The winner will be notified by email to the email address provided on the completed profile. If a potential winner cannot be reached at the email address provided and does not respond to the Sponsor within five (7) days from Sponsor’s first attempt to contact him/her, or if he/she is found to be ineligible, or if he/she cannot or does not otherwise comply with these Official Rules, an alternate winner will be selected by random drawing. All entries become the property of the Sponsor and will not be returned.
